FALSE CASE FILED BY SC/ST MINORITY COMMUNITY
18-Feb-2023 (In Domestic Violence Law)
A person who is working under me is not performing well in job since last few months instead of regular intimation from time to time. He is from SC/ST minority community.
He is regularly threatning if you sent me out of office then I will file a fake SC/ST minority case against you that you are harrassing me mentally.
How to get rid of this situation because I have read that in ground reality, it is a Non-bailable offence and SC/ST people are misusing it. Police first arrests the other person and then asks about what exactly happened.
Could you help me out with a fix for this.
at the time of employment have you signed a contract are you paying PF and ESI or not. You can remove the perosn as per the legal way as suggested by the goverment. Also we need to know how long has he been working under you is the salary being paid in cash or in account

Yes it is true as per the law however police On the other hand is also required to apply a reasonable application of mind in these kind of cases. you are advised to create foolproof evidences like recording hus threats on your mobile and in presence of other individuals who can give evidence in your favour etc. All phone recordings if are uncut and edited are good evidence. So this only you require, thats all plus try to sack this kind of employer asap.
