Since a fresh domestic violence (DV) case has been filed against you but you have not yet received any formal summons—either in digital or physical mode—you are not required to attend court until proper service is effected. However, as the first hearing is scheduled in 7 days, it is advisable to check with the court registry or online case status using the CNR number or party name, if available, to avoid any ex-parte orders. Under the Protection of Women from Domestic Violence Act, 2005 (PWDV Act), it is mandatory that the Magistrate takes cognizance of the complaint and then issues a valid summons to the respondent before requiring their appearance (Section 12, read with Section 28, PWDV Act). The Magistrate cannot compel your presence or make orders against you until you have been duly served with the summons as required by law. In the absence of summons, no penal action or adverse orders can be lawfully passed against you. Nevertheless, proactively monitoring the case and preparing your response in advance is prudent. If you have concerns about irregular or improper service, you can raise this as a preliminary objection at the earliest opportunity after service. Should you need assistance with drafting responses, checking court status, or attending proceedings, you may contact for professional legal support.

Hi there, has IO informed you ? Were you called for Investigation? If no information of any sort is given then no need to be present in court. Since, it's first hearing and no summon received it can be because IO might be filing a Final Report or IO will have to first establish the case then only court will send the summons.

since you have not yet received any summons either physical or Digital there is no legal obligation for you to appear on the first date unless the court has duly served you however sometime summons are served late or through alternate mode you may check case status on the District Court website or E-court app to confirm it if your name is reflected if the summons is not served , the matter may be adjourned on the first date still it is advisable to keep track and if possible, engage a lawyer to appear on the date so that no adverse order is passed in your absence.
