Domestic violence filed by wife

Husband and wife are not staying together since 2 years. Husband is totally innocent. After two years wife filed domestic violence under sub section 12,17,18,18,20,22. according to section 17 she can enter in share household. But now husband don't want to stay with her. How he can avoid her entry in his House. Actually he want divorce now and he has a benifit of two years of separation. As they are not staying together from August 2018. Any solution in behalf of husband?

he will have to contest domestic violence case at the court and at the same time he can file for divorce if he has certain proofs of ill behaviour of his wife with him or anything related. Staying seprate since 2 yrs shows that she has left the company of her husband.

in this case it is advisable that firstly you have to challenge the said proceedings before the hon'ble high court for quashing of DV case. you can also proceed to file divorce petition under the ground of mental cruelty and desertion. you can oppose her entry in your household by holding her responsible for harassment to you and your relatives

on the ground of Seperation with Cruelty husband can go further for Divorce. He can take Averment about Domestic violence case has filed with malafide intension. how many days she resides with husband after marriage will be helpful for Divorce petition.
