Domestic Violence Case From 2021 Still Not Maintenance

Hi I am hindu woman,now age 42 yrs old.my husband and his family throw me and my 1.5yrd old daughter out for the house in April 2020 then I filed NC and went to my parents house and in 2021 I filed for domestic violence case at my place at magistrate court as it was my local court..but due to delaying in cases we only got dates and dates and when we send to mediation then my husband is not ready for the settlement and that also he is telling that I am not ready to to settlement and now after 5 years there is no hearing on interim etc..in 2022 we submitted our income statement that time I was not working but as I have to bear my daughter school exps so I started doing job..now he is going in court and asking to give me my income statement ..today then we told to submit in next date..and in court he has submitted his salary as 15 thousand per month as his boss gives personal favot to him and transfer balance salary in cash to him..so I am not able to track his actual income..pls help
you should file an application for an interim maintenance case, saying that the matter is pending since 2021 without interim relief. If your husband is showing only 15,000 salary, you can file an application for production of documents and the court can direct him to produce the Bank statements,Income Tax Returns,Salary slips etc
You are legally required to submit your updated income affidavit as per the Supreme Court guidelines, so do not hide your employment. However, your working status does not absolve your husband of his legal and moral duty to maintain his child.
To expose his hidden cash income, you need to file an application under Section 91 of the CrPC
