Can i file a Domestic violence against my husband and mother-in-law

I and my husband are staying in two different states of India due to our job. We got married on 6.12.2013. Now my husband is having an affair for the last 1 year and he is totally ignoring me since 8 months by not picking up my phone calls and also not replying to my any sms. He kept on telling me that neither he will stay with me nor he will divorce me. I am now in a dilema. I have the call details of my husband. He and his family members threating me filing a case against me. My husband is torturing me mentally. I have fully shakened by his behaviour. His mother are provoking me and kept on saying that this affair happend due to me and her son is a smart guy so he can do this. What can i do now? Is it necessary to cohabit with my husband than only i can file domestic violence?
You can file a divorce petition mentioning the allegations since the act of your husband is itself a criminal offence and falls under adultry and at the same time your mother in law is also supporting him in his actions therefore filing a divorce against him is advisible and since he is not wiling to give you the divorce then the only option left is filing divorce on contest. instead of filing domestic violence there is another way of filing maintenance case which is criminal law in nature and it can jail him you have to trap him properly so proper homework is needed moreover do you have injury report to substantiate
