Registered POA in husband's name to complete registration formalities
02-Jun-2023 (In Documentation Law)
Me and my husband jointly own an apartment. I want to give POA to my husband for completing property registration formalities, as I am travelling out of country. Do we need to get power of attorney registered or notarised document will be sufficient?
Hello, for the purpose of registration you can execute a specific power of attorney in favour of your husband. The POA will be only for the purpose of registering the property. It can be done on a stamp paper duly notorized.
In view of the supreme court decision regs POA is necessary for property registration.
Notarised POA is not valid.
If you want to transfer your share to your husband you can go for regd rights relinquish in favour of him deed or if you and your husband wants to sell the property then Regd POA is necessary
