To obtain a succession certificate, you have to file a succession petition in the district court having jurisdiction where the property is located.
Yes, as per your query, every legal heir has to be present in the court during the time of hearing.
And as far as the court fees is concerned, a fixed percentage of fee is levied on the total value of the assets on which succession is claimed.

Succession certificate is different from the legal heir certificate.
Succession certificate is issued by the Ld. District Delegate in relation to the moveable property left by the deceased, such as fixed deposit, share , monies in bank account.
Legal heir certificate can be done by mere Affidavit from the 1st class magistrate, where one or all of the legal heirs can take oath before the Ld. Magistrate.
It differ from Advocate to Advocate relating to the fees.

For succession certificate you have to file a petition on district court where asset has been located.with petition you have to submit death certificate no objection certificate from other legal heir.after filing petition court will give advertisement in newspaper.If there is no objection against your petition then court will issue succession certificate.fee will be fixed percentage of asset valued along with lawyer fee.
