My name wrongly mentioned in sale deed on my wife's name what to do

30-Jun-2023 (In Documentation Law)
I recently bought a flat on my wife name. My name is XXX. However the sale deed mentions wife's name w/o YYY, which is incorrect. It should be wife's name w/o XXX. The property is in my wife's name. How should I rectify this mistake and what are the problems I would face. The original paper is deposited with the bank which sanctioned our loan. What should we do?

Hello,

Confirmation deeds are also known as correction deeds. They are entered into between parties to rectify any errors made in a previous deed. These errors may include typing error, misspelt name, error in property description, or any other error in execution of the documents. These mistakes can be later corrected through a deed of confirmation.

For mistakes like spelling mistakes, the stamp duty and registration charges are Rs 100 each. In case the rectification deed relates to the area, names of the parties or the extent of the property, the stamp duty and registration charges as applicable to the conveyance deed are payable. In case some of the parties to the agreement do not agree to such an amendment or rectification, the other party may file a suit before a court under Section 26 of the Specific Relief Act 1963.

Regards
