Can a gift deed be challenged in court

Dear sir, My grand father have three sons. My father was middle one and he was died at the year of 2000. My grand father has constructed area 150 yards. My grand father was write a gift deed to each one have 75 yards.but he was not write a property to me. Sir in this issue I have any rights to challenge on court. Have any chances to get property through court. Please give me the advice. Thanking yousir

Dear Client,
Information is insufficient to answer the query. What is the nature of the property. Whether it is the self acquired property of your grand father or ancestral property. That is to say, whether he has inherited the property from his parents. If it is inherited from his parents then even if he executed gift in favour of anybody your father can challenge. Otherwise your father has no right to challenge the Gift that was made by your grand father.

Your Grand Father had gifted to your father and uncles (father's brothers) when he was alive, hence the property had been already transferred to them. Now there is nothing left for you to claim by you by succession. If the gift deed is not registered, there are some chances. However, you have not mentioned your religion. Clarify the above points so that I can give you correct opinion.
