Wife wants to file for divorce as living separately already

Hi, I was married 1.4 years back, but I lived at my in laws house only for 7-8 months, for another 7-8 months I am living alone, my husband is living with his parents and he didn't even talk to me. And whenever I try talking to him and send him a message he directly forward it to his dad, he is hiding behind his parents, who are the main reason for this separation. First they faked being broad minded and accepted me being a working women. But later they said they always wanted a housewife for their son. I did household chores as per my strength and time but it was getting very difficult. They tortured me and asked me to leave the home. Having no choice and for my career I left the house because I didn't even have my husband's support. Now they are not responding at all. Not picking up my parent's call as well. We just want a divorce on mutual consent and my belongings from that house. But since they are not responding to us, can you please help me how to proceed with the same?

Dear Client,

You can take legal action against your husband and in laws as per various laws. If you want to patch up your differences and request your husband to support you , you can try and see with your parents and relatives with a warning of legal action.

Further, if you really wants to get separated and divorced from your husband on mutual consent , you can go ahead.

Hi,
You can file an initial Petition for Divorce which could be a contested petition. Once he is served and comes to Court the same can be converted to Mutual Consent at any stage. As of now, as they are not responding it would be difficult for you to get them to agree for mutual consent divorce Petition. Best is first get them to come to Court and then get the Petition converted like you desire to Mutual consent.

You need to send legal notice for divorce and if you wish to reunite and compromise then send notice through your advocate for restitution of conjugal rights.

There are other legal remedies available to get back your belongings and also to claim maintenance.
