Wife Threats of fake cases and tortures mentally.

My Wife: She already married to someone(Govt Job) in the past she told me that they are divorced, she told me that she filed case on him and taken money. After some time she finds another men BF (govt job army) filed case 376 on him and get away. Then I came in her life we got married (love marriage) she threats me of fake cases and tortures me mentally. What do you think are the previous cases are also false. Not confirm she is divorced or not.

U can file a case of criminal intimidation on her and also divorce case on grounds of cruelty .If she has really divorced her previous husband's then the court /police will ask for her previous court orders of divorce .If she has not divorced them then u can also take divorce from her on grounds of adultery .Contact me

You should immediately consult a lawyer and send your wife a legal notice underscoring the illegal threat being extended by her. Simultaneously, you may also choose to file a criminal case of a police complaint.

You can consider filing for: Annulment under Section 12(1)(c), if you believe she intentionally concealed her past with the intent to deceive. Divorce under Section 13, if: She has committed cruelty. You found out she's having an ongoing extramarital affair. Courts require strong proof for fraud or cruelty. Just having a past affair is not enough

If your wife was not legally divorced from her previous husband at the time of marrying you, your marriage may be considered void under Section 11 of the Hindu Marriage Act, 1955 due to bigamy. You can file a petition for annulment on this ground. If the divorce was claimed but not lawfully granted by a competent court, it amounts to fraud and misrepresentation, which is also a valid ground for annulment or contested divorce under Section 13(1)(i) (adultery or cruelty). Further, if she is threatening you with false criminal cases and mentally harassing you, you may seek protection under Section 498A IPC misuse, and also approach the High Court under Section 482 CrPC to quash any false FIRs. You can also file a complaint for criminal intimidation and mental cruelty. It is advisable to immediately verify her marital history through court records and take legal action accordingly.
