Wife says 'yes' in Section 9 HMA , but acts otherwise
03-Mar-2025 (In Divorce Law)
I filed a petition u/s 9 of HMA. We were sent to the counsellors at the first date.
During counseling she agreed to the idea of reuniting and the counsellors adviced us to be in contact till next date.
She doesn't initiates or responds to my calls a or messages. Also, She sought to take interim maintainence u/s 24 HMA.
I want to know where is she trying to lead this case and ultimately what she wants as there is conflict in her statement and behaviour.
You should communicate this to the counselor. You can show the screenshots of your messages and blue tick of whatsapp messages and non response from her side.
And you can also deny paying monthly interim maintenance to her if she is ready to reunite.
For more details, You should contact your advocate personally.
I understand your concerns regarding the ongoing matrimonial dispute, and I appreciate your patience during this process. The key to resolving such matters effectively is to balance legal rights with a practical and amicable solution.
To proceed, we can explore the following options:
1. Mediation & Settlement – A mutually agreed settlement can save time, legal costs, and emotional distress. We can negotiate terms, including alimony, child custody, and division of assets, ensuring fairness to both parties.
2. Legal Proceedings – If an amicable resolution is not possible, we can proceed with litigation to protect your rights under family law. We will prepare strong legal arguments to present your case effectively in court.
3. Child Custody & Support – If children are involved, their well-being is a priority. We will ensure that custody and financial arrangements serve their best interests.
4. Financial & Property Settlements – A fair division of assets and liabilities will be sought to avoid prolonged disputes.
