Wife mentally tutoring me what action can I take

07-Mar-2023 (In Divorce Law)

Hi, a month ago,my wife said she doesn't want to live with me because she is lesbian. In a month she made my life so miserable that I left my home 4days ago. Now, she is not letting me meet my daughter who is 4.5yrs old and now, she is saying that she is not a lesbian & that was just false so that I leave the home. Iam still ready to live but she is not. She has very close talking terms with my homelord & she shares every incident with him. The day I left my home, the homelord called to threaten me if I come there. My wife is non-working & is 10th Pass. How can I get my child custody? pls help

It will be better for you file section 9 petition against her . when she appears before court either there will be compromise between both of you or things will be decided which way to go. In that council u may ask for your child custody.

You need to file a complaint at Police station and file custody petition before court for custody of your child, You must mention cruelty and difficulties raised by your wife. Try to collect evidence of being your wife lesbian.

You have to file an application int he court seeking custody of the child. You will have to give details of the entire incident and how she is troubling you and what effect it causes in the mind of the little girl. All chances are there she may also file a petition for divorce, it is upto you whether you want to contest the same or file a petition for conjugal rights if you are willing to stay with her in future. But if both of you donot want to stay together, you can mutually take divorce.

If you want to bring her back then file sec 9 od hindu marriage act and if you only want to custody of your daudhter then file a case for her custody but there is apprehension that then your wife will also file false and frivolous case against you .so you have to be causioned too. Rest on meeting.
Thanks and regards
