Wife leaving 2yr child in her mother's place

31-Oct-2023 (In Divorce Law)
My wife is harassing me like anything, she doesn't provide me food, she doesn't talk to me, she sleeps separately. She has government work and finds difficultly in looking after the 2 yr child, so she is leaving the child with her mother far away for along period. In such case after some time can i get away the child from her mother with help of some social agency and file for divorce. What will be the chances of me getting the child custody?

Respected from your facts, i can sugest you that, in case if you want chidren you can move an application for custidy if chidlren. It is a family matter and social agency do not have any power to help you in any manner. Only the court have power to decide your child custody. Regarding divorce, required further discussion. For time being move an application in Guardian and Wards Act and sought for custody of child. Since you are a father and you have absulte right. On the other side you infomred that the child is of 2 years and as per rule, the female child should be with mother custody till it attain age 7 years. So please contact your known advocate or you can contact us alson throught this Law Rato. Need Discussion to answer your question

That  your wife being a Government employee and she has left your child with her mother and does not cook for you will not be sufficient ground for you to obtain a  divorce from her. And about custody of child you can bring the child from her mother`s place right away and start looking after it if you can continue to d so. But along with all that her not sleeping with you will be a good ground for divorce for you and also to get custody of child.
