After my Hindu marriage, my wife lived with me for 8 months in UK alone & then she was pregnant & went to her mothers house for delivery in India. Its been more than a year since she went to her mothers place & we also had a baby, now she is refusing to come back to my family. She doesnt want to live with my parents. She wants to live alone & wants me to give up on my parents which I cant. Only if her demand is fulfilled she is ready to come. We are not happy with how its going & we have been abused & mentally tortured & now allowed to see the baby. We have given up on her and have started ignoring her and her dramas.
1. what to do to have the baby after divorce ?
2. Can I move on & have a Live-In relationship with another women without divorce .
3. She is planning to work & take care of the baby. Am I still legally bound to pay her ?
4. She is living with her mother for 1yr now. if she lies to police to file a complaint on us, how to tackle ?
The parent with whom best welfare of the child exists is allowed to get the physical custody and other parent get the visitation right. According to Hindu Minority and Guardianship Act, 1956, the mother is always given the first preference if she wants the child with her.
