19-Nov-2025 (In Divorce Law)
I got recently married for little more than an year. My wife is a govt employee and we used to stay near her office in a remote village due to her work. All of a sudden she started saying she want to live alone and when i try to stay with her in the same house she goes to police station and files false cases against me in police station. she wants me to be removed from the house. Police without any investigation they forcefully ask me to leave. I want to stay married. Whats my course of action.

ask her whether she really interested to stay with you,may be as per your version she want to get away from you physically and mentally it's better sit with her with some elders and decide yourself....not even one year that's a clear indication she is not interested in you.

Based on your facts, your wife’s conduct amounts to clear marital cruelty and misuse of the police machinery. Police cannot legally evict you from a shared household without a lawful court order. If she is filing false complaints, you should immediately submit a written representation to the SHO, DSP/ACP, and SP stating the true facts and requesting that no action be taken without proper inquiry (this will protect you from false FIRs). You may file a petition for Restitution of Conjugal Rights (Section 9, Hindu Marriage Act) seeking a court direction for her to resume cohabitation. This will legally record your intention to continue the marriage and will counter her false allegations. If she continues threatening false cases, you can file a complaint for criminal intimidation and misuse of law, and also seek anticipatory bail if any FIR is registered. In addition, preserve all messages, call records, and incidents as evidence. You have every legal right to stay married, and no authority can remove you from your own matrimonial home without due process. Strong legal steps from your side will prevent further harassment and ensure protection of your rights.
