Wife getting married to another guy without divorce

Hi, this is my brother's issue. He and his wife got married in 2021( register marriage)and did not disclose it to anyone and once the girls parents came to know about it they took her in and changed her mind. Now she's getting married to another guy without divorce even after sending RCR summons. Can we submit those 2nd marriage proofs in court? If yes what will be the consequences. And any hope that my brother will get justice? Kindly suggest. Thanks in advance.

hi yes you could submit any available evidence in the court showing proof that she is getting married without being divorced and to take into proof and if she is not coming back to marital home then you could file divorce after that

If u hold 1st marriage certificate them second marriage is not valid and u can file a petition that ur brother wife is in house arrest by her parents and forcing her second marriage if possible give a complaint at PS

If either the husband or the wife, without reasonable excuses, withdraws from the society of the other, the aggrieved party may approach the Court for restitution of conjugal rights. Conjugal Rights Restitution is a legal entitlement that is based on Section 9 of the Hindu Marriage Act. The aggrieved party may apply to the district court for restitution of conjugal rights if the husband or wife is withdrawn from the other partner's company without valid.
