Wife earning sufficient,filed maintenance case u/s125,we have no child

My wife is educated MD homeopath. She has deserted me in 2015.(2 months after marriage) she filed divorce case and crpc125 in July 2015. In November 2015 she started doing job in education institute as biology teacher. She is earning 36000/-in hand salary. I m earning 4 times of her income. In such case can she claim maintenance. We have no child. She has no responsibility.

According to supreme court latest judgement she cannot claim maintenance if she is enable to maintained her self. Their is numerous judgment on that you can rely. It is matter of argument, how to convince

You have a very good case. You need to engage a good lawyer who would represent you in the court. Your wife's act of desertion coupled with her income makes her chances very deem that she would get any maintenance from you.

No maintainence must be granted if wife has a sufficient source of income and thereby you need to file proof of her income like salary slips etc to prove this in court and thereby contest the case of maintainence.

The maintenance issue depends on courts verdict its completely the discretion of court.There have been apex court judgement s where it has been ruled that even a working wife has to be maintained by husband if she doesn't have sufficient means besides that there are other factors to be considered like living status etc, It can be vice versa as well.Therefore its very difficult to comment on but the facts and circumstances of the case defines it very well.Therefore please discuss in detail to get a correct reply you can contact on the listed details thanks.
