Wife cheated me with the name of marriage
19-Jul-2023 (In Divorce Law)
Had married since 3 years but not lived together for 2 months. Had spent almost around 8 lakh rupees so far for her for the jewels and electronics within the short duration of 2 months since I trusted her initially. But we seperated afterwards and now she neither ready to live with me nor to return the items back to me. She also agreed to give mutual divorce to me if I do not ask anything which I given to her. If I ask, she is telling that will go for maintenance case etc. What should I do?
Dear client
if both are decided and go for mutual consent means both of you settled amicably... but if you are interested to get back the cash and jewels she might be claim for maintenance. before she initiate something you should issue legal notice through an advocate stated restitution of conjugal rights..for more call me through lawrato.

There are multiple case laws from Supreme Court judgements which clearly say that any expenses incurred by a couple during the term of marriage is not a financial transaction, and neither of the couple can approach court to get refund of the same. That being the case, in your matter, with a women who neither wishes to live with you, nor give you a clean exit, I would highly recommend to you that it is better if you can get a Mutual Consent Divorce and come off from her without any issues of Domestic Violence or any such matter.
