whose responsibility it is to send off divorce related petitions

my lawyer told that opposite party is refusing to accept maintenance petition. is this possible? i have not been asked to send my petition but my husband has personally sent his handwritten envelope to me when he filed for divorce. does that mean i can do the same as well! it seems or is made to seem like sending/handing over of the petition is a bigger problem than the petition itself.

I think your lawyer is hand in gloves with your husbands lawyer, if at all he has to serve, why by hand, let him speed post it, if there after, also your husband refuses or lawyer refuses, it will be good service on your part which you can show court, you must change your lawyer with immediate effect

In this situation you can sent it through local police station. you can also file a Petition under order 20 Rule 5 for advertising about the case through local news paper. Now a days, Refusing/avoiding summons is a delatary tactic of the opposite party. For further details you can contact with us.
