Under Section 19 of the Hindu Marriage Act, 1955, a contested divorce petition can be filed before the Family Court having jurisdiction over (i) the place where the marriage was solemnized, (ii) the place where the parties last resided together as husband and wife (matrimonial home), or (iii) where the wife is residing at the time of filing. Based on the facts stated, if the parties last resided together at Perumbakkam, the husband may file before the Family Court having territorial jurisdiction over Perumbakkam. However, the exact Family Court jurisdiction in Chennai should be verified based on the notified territorial limits to avoid objections.

For a contested divorce under the Hindu Marriage Act, the petition may be filed before the Family Court having jurisdiction over: (i) the place where the marriage was solemnized, (ii) the place where the parties last resided together, or (iii) where the respondent is presently residing. If the matrimonial home was at Perumbakkam and the parties last resided there, the Chennai Family Court having territorial jurisdiction over that area would ordinarily have jurisdiction. The wife's Aadhaar address alone is not conclusive; her actual place of residence and other jurisdictional facts are relevant.

A contested divorce may be filed in a court having territorial jurisdiction based on the applicable personal law, which can include the place where the marriage was solemnized, the place where the parties last resided together, the place where the respondent resides, and, in certain circumstances prescribed by law, the place where the petitioner resides. The correct Family Court is then determined by the territorial allocation of that locality.
