Questions Answered by Advocate A.K Azey Kumar Rhakul

Q: Online Job scam- Asking to pay huge amount and legal notice

I have received a WhatsApp message stating that I have to fill out 600 forms in 6 days, and each form get 32 rs total around 19200 rupes salary. So they took passport-size photos, driving licence ID and online signatures for filling an agreement. To quit the deal and job, they are asking for 32,000 rs and also a fine for not completing the work of 6900 rs. It is a trap now. They are threatening to send a legal notice since I have signed an agreement knowingly. And lawyer notice. What to do? HELP

Advocate A.K Azey Kumar Rhakul answered
This is a scam. Do not pay them anything. Block their contact immediately and do not respond to their threats. Do not share any more personal details with them. File a complaint on cybercrime or visit the local Cyber Crime Police Station. If they continue harassing you, we can send a legal notice warning them against fraud and extortion

Q: Unknowingly opened current account in my proof for scammers

There are complaint on that account , what can I do in legal ways, I got trapped in that case so please kindly give some advice to take a relief from that

Advocate A.K Azey Kumar Rhakul answered
If a cybercrime complaint has been filed against you, first obtain a copy to understand the allegations and the sections applied. If there is a risk of arrest, apply for anticipatory bail under Section 438 CrPC. If the case is based on false allegations, consider quashing the FIR under Section 482 CrPC in the High Court. Gather digital evidence, chat records, emails, or IP logs to prove your defense. If falsely accused, you may file a counter-complaint for misuse of cyber laws.

Q: Do I need to stay in a different house before filing divorce?

I want to proceed with a divorce petition. My wife wants to stay in my rented house and doesn’t want to leave. I don’t have means to rent a separate accommodation for myself. How and when can I file the petition?

Advocate A.K Azey Kumar Rhakul answered
You can file a divorce petition under Section 13(1)(i-a) or (i-b) of the Hindu Marriage Act, 1955 immediately. Since the house is rented in your name, she has no automatic right to stay. You may seek exclusive possession under Section 19 of the Domestic Violence Act, 2005. If she refuses to vacate, request the Family Court for necessary orders. If needed, mediation can be considered before proceeding legally.

Q: during partition case can we bulid house

the lands are inheritance, my grandfather have two wifes, 1st wife have 1 son and 1 daughter and 2nd wife 3 sons and2 daughters. vaayivali partition done approximates befoe 30 years like 3 parts. one part is 1st wife son and another 2 parts divide by 2nd wife sons, all the three members have house in inheritance land, one member that's my dady death 18 years before no house, now some problems going like 1st wife son asking partition as two parts in 7 years. now we want house so what we do?

Advocate A.K Azey Kumar Rhakul answered
Since the vaayivali partition was done 30 years ago, the first wife's son's claim for a fresh partition after 7 years may not be valid if the division was properly documented. As your father had a rightful share, you, as his legal heirs, can construct a house on his portion. If there is interference, you may seek a declaration suit to confirm your share and an injunction to prevent obstruction. If possible, try for an amicable settlement; otherwise, legal action may be required.

Q: Private bus was late and bus was described as volvo

I booked a private bus - Annai travels from Bangalore to Karaikudi. The bus was 2 hours late. They charged me 2586 RS. The bus was described as volvo but it wasn't. The bus was unclean as well

Advocate A.K Azey Kumar Rhakul answered
You may file a complaint against Annai Travels for misrepresentation and deficiency in service under the Consumer Protection Act, 2019. Since the bus was not a Volvo as advertised, was unclean, and was delayed by two hours, you may first demand a partial refund by directly contacting the travel agency. If they fail to respond, you may escalate the matter by lodging a complaint on the National Consumer Helpline or approaching the Consumer Disputes Redressal Commission for appropriate relief.
