Q: Legal advice for not appearing in court for myself
Ex husband applied for divorce first hearing on June 10,I didn’t appear, next was on July 4th,final call on July 23 which I will not appear and I am also willing to give divorce I have a girl baby I don’t need alimony or anything from him that’s why I didn’t appear but I need divorce too but the other party appeared for 1st and 2nd hearing what I should do further?
Advocate A.K Azey Kumar Rhakul answered
Based on your query, do not ignore the court proceedings. If you also want the divorce, it is advisable to appear before the Family Court on the next hearing date or engage an advocate to represent you. If you remain absent repeatedly, the court may proceed ex parte based on the available evidence. You may inform the court that you have no objection to the divorce and clarify your stand regarding alimony, child custody, and maintenance for your daughter. Since a minor child is involved, the child's welfare remains the court's primary concern. Obtain proper legal advice and participate in the proceedings to protect your rights. Since the property is in Pune, Maharashtra, the applicable Maharashtra stamp duty and registration rules will apply. The deed should generally be registered before the Sub-Registrar having territorial jurisdiction over the property. Verify the latest charges before registration.
Q: which jurisdication court to file for divorce
husband addresss matriomonial home address in perumbakkam. wife address in aadhar is valasaravakkam, but living in gerugambakkam. if husband decided to file contested divorce, which family court in chennai to file. hearing now there are multiple options ?
Advocate A.K Azey Kumar Rhakul answered
Under Section 19 of the Hindu Marriage Act, 1955, a contested divorce petition can be filed before the Family Court having jurisdiction over (i) the place where the marriage was solemnized, (ii) the place where the parties last resided together as husband and wife (matrimonial home), or (iii) where the wife is residing at the time of filing. Based on the facts stated, if the parties last resided together at Perumbakkam, the husband may file before the Family Court having territorial jurisdiction over Perumbakkam. However, the exact Family Court jurisdiction in Chennai should be verified based on the notified territorial limits to avoid objections.
