Questions Answered by Advocate Hemalatha Narayanan (100+ answers)

Q: Bank not abiding by court order

What action I should, as a 80 yr old, take having won case in district consumer redressal commission and bank is NOT honouring court verdict . Bank continuously harassing me.

Advocate Hemalatha Narayanan answered
If the bank is not complying with the District Consumer Commission’s order, you can file an Execution Petition under Section 71 of the Consumer Protection Act, 2019. The Commission can impose penalty, interest, attachment of property, or even imprisonment for willful non-compliance. You may also seek compensation for continued harassment. Considering your age, request priority hearing and strict enforcement of the order.

Q: Fake cheque cases from 2023 no action is taken by the police or advoc

Cheque fraud by four members of one family involving ₹15.99 lakhs. Two cheques were fake with no bank account and two were dishonoured. I lent money in cash and online in 2022 for personal needs. Member 1 promised repayment in six months, issued cheques and promissory notes, later denying responsibility and signature. Legal notice was issued; they falsely accused me of stealing documents. Advocates delayed filing and gave no case number. Police demanded court direction for FIR. CM Cell complaint

Advocate Hemalatha Narayanan answered
You should file a private complaint under Section 200 CrPC before the Magistrate seeking direction under Section 156(3) CrPC for registration of FIR. Parallelly, initiate Section 138 NI Act proceedings for dishonoured cheques and a civil suit for recovery based on promissory notes. Forged cheques and denial of signature attract serious offences. Advocate delay does not bar your remedies; act promptly with court intervention.

Q: expide pending crp eviction in high court

can I file Slp in Supreme court to expide or set aside pending high court eviction crp and interim stay . if possible what cost range to hire Supreme court lawyer.

Advocate Hemalatha Narayanan answered
An SLP under Article 136 can be filed before the Supreme Court against High Court orders, including interim orders, but it is discretionary. The Supreme Court generally interferes only if there is grave injustice or jurisdictional error. You may also seek expedited hearing before the High Court itself. Costs vary widely depending on counsel and complexity; Supreme Court litigation is usually expensive and outcome-dependent.

Q: Traffic challans for a bike sold in June 2023 but RC not transferred

I sold my bike (TN09 XX XXXX) to a dealer in June 2023 with a Purchase Estimate as proof, but the RC was never transferred. I have now received two Kerala traffic challans from October 2025 and same has been transferred to Virtual Court automatically after 90 days. Since I am no longer in possession of the vehicle, what should I do in this case because just paying the court fine will admit guilt and contesting the case transfers it to regular court in Kerala whereas I am in Tamil Nadu, Chennai.

Advocate Hemalatha Narayanan answered
Since you sold the vehicle but RC was not transferred, you should immediately submit Form 29 & 30 with sale proof to the concerned RTO and inform them in writing. File a representation before the Kerala Virtual Court attaching sale documents and request dropping of proceedings as you were not in possession. You may also lodge a complaint against the dealer. Paying fine may imply admission; contest with documents to avoid liability.

Q: Judgement certified copy required

1966 civil .hc. Madras certified judgement copy required. Cost and time rqd.offline.

Advocate Hemalatha Narayanan answered
Certified copies of old High Court judgments can be obtained by filing a Copy Application before the Copying Section of the Madras High Court. You must provide case details (year, parties, citation if available). For very old cases, records may be in the Record Room/Archives, so additional time is required. Cost is usually nominal (copy fees + search fees). Time may range from 2–6 weeks, depending on availability of records.
