Q: Financial negligence/ Domestic violence

My sister married to a guy in Chennai, His financial situation is not disclosed, despite he receives decent salary struggles to meet basic family needs. It is unknown where he is spending. If any question raises regarding finances he is abusing verbally and physically. After 4 episodes of physical abuse we took my sister to our home. It’s been 2 years, he is threatening her in phone not to work, not allowing child to go to school without his permission even he doesn’t come to my house. Solution?

The facts indicate possible domestic violence, including physical abuse, verbal/emotional abuse, threats, and controlling behaviour. Your sister can approach the Magistrate under the Protection of Women from Domestic Violence Act, 2005 and seek appropriate reliefs such as a Protection Order restraining further abuse or threats, Residence Order, Monetary Relief/maintenance, compensation for injuries and mental agony, and interim relief.If there is a genuine apprehension regarding the child’s education or safety, she can also seek appropriate custody/child-related orders, keeping the welfare of the child as the paramount consideration. The husband’s income and financial details can be sought through appropriate proceedings, particularly while claiming maintenance or monetary relief.For the physical assaults and threats, a police complaint may also be considered depending on the specific facts and available evidence. Medical records, photographs, messages, call recordings (where lawfully obtained), witness details, and other evidence of abuse should be preserved.She need not return to the matrimonial home merely because the husband threatens or pressures her. The appropriate remedy will depend on the marriage, place of residence, child’s age, income of both parties, and the exact nature of the incidents. A consultation with a matrimonial lawyer is advisable before initiating proceedings.



Q: Dubai Tourist Visa Eligibility with Pending Criminal Case

I am a petrol bunk owner. In December 2024, one of my drivers took my truck without my knowledge and used it to transport diesel without a bill. Civil Supplies Police seized the truck, and I was arrested and added as A1 only because I am the vehicle owner. I obtained bail within 4 days and have no other connection to the offence. No charge sheet has been filed till date. I now wish to travel to Dubai for tourism. Will this pending case affect my Dubai tourist visa or travel? What is theprocedure

A pending criminal case does not automatically prevent you from applying for a Dubai tourist visa or travelling abroad. However, since you are an accused in a pending criminal case, you should first check the conditions imposed in your bail order. If the bail order requires prior permission before leaving India, you must obtain permission from the concerned trial court before travelling.You may file an application before the concerned criminal court seeking permission to travel to Dubai for tourism, mentioning the proposed dates, purpose of travel, duration of stay and undertaking to return and cooperate with the proceedings. The court may impose conditions such as furnishing an undertaking, providing travel details and ensuring your appearance on hearing dates.Since no charge sheet has been filed till date and you state that you have no connection with the alleged offence, these facts can be brought to the court’s notice. You should also verify whether any Look Out Circular, warrant or specific restriction on foreign travel has been issued against you.As regards the Dubai tourist visa, the pending case may be relevant to visa/passport processing, but it does not by itself mean that the visa will necessarily be rejected. Do not travel without obtaining the required court permission, as violation of bail conditions can have serious consequences. The Supreme Court has also recognised that foreign travel by an accused on bail is subject to the criminal court’s permission and conditions.



Q: rental lease money recollection from property owner

Hello, I took a property on lease before 2 years for INR 5,00,000. I vacated the property last year and property owner has paid only 30% of the lease amount and the owner is postponing until he gets next lessee. I still have access to property and the owner is okay with me to use the property until he repays, but I have no use with it. I have evidences of rental agreement, call and whatsapp recording. what step should i take in order to realize my money from the owner. Thank you

Based on the facts stated, you should first preserve the lease/rental agreement, proof of payment of the ₹5,00,000 lease amount, proof of vacating and handing over possession, and all relevant WhatsApp messages and call recordings. You may issue a legal notice to the landlord demanding repayment of the outstanding 70% of the lease amount within a specified period. If the landlord fails to repay despite the notice, you may institute a civil suit for recovery of the amount, subject to the terms of the lease agreement. If the agreement contains a specific and unconditional obligation to refund the amount, the possibility of summary proceedings under Order XXXVII CPC may also be examined. The landlord cannot indefinitely postpone repayment merely stating that he will pay after obtaining the next tenant, unless such a condition was specifically agreed in the lease agreement. The limitation period and appropriate court having jurisdiction should also be verified before filing the recovery proceedings.

நீங்கள் கூறியுள்ள தகவல்களின் அடிப்படையில், முதலில் காவல் நிலையத்தில் அளித்த புகாரின் நகல் மற்றும் மகளிர் ஆணையத்தில் அளித்த புகார்/உத்தரவு ஆகியவற்றை பாதுகாத்து வைத்துக்கொள்ளவும். காவல்துறை FIR பதிவு செய்ய மறுத்தால், BNSS பிரிவு 173(4)ன் கீழ் மாவட்ட காவல் கண்காணிப்பாளரிடம் எழுத்துப்பூர்வமாக புகார் அளிக்கலாம். அதன்பிறகும் FIR பதிவு செய்யப்படாவிட்டால், BNSS பிரிவு 175(3)ன் கீழ் சம்பந்தப்பட்ட குற்றவியல் நீதிமன்றத்தில் மனு தாக்கல் செய்து விசாரணை/FIR பதிவு செய்ய உத்தரவு கோரலாம். திருமணம் செய்வதாக ஆரம்பத்திலிருந்தே உண்மையான எண்ணமின்றி வாக்குறுதி அளித்து உடலுறவு கொண்டதாக நிரூபிக்கக்கூடிய சூழ்நிலை இருந்தால், BNS பிரிவு 69 உள்ளிட்ட பொருத்தமான குற்றப்பிரிவுகள் பரிசீலிக்கப்படலாம். மிரட்டல் இருந்தால் அதற்கான ஆதாரங்களையும் (WhatsApp, call recording, messages) பாதுகாத்து தனியாக புகார் அளிக்கவும். ஆவணங்களை ஆய்வு செய்து உள்ளூர் வழக்கறிஞரின் மூலம் உரிய நீதிமன்ற நடவடிக்கை எடுப்பது சிறந்தது.

If two registered documents have been executed in respect of the same property, the remedy depends on the nature of the dispute. Generally, cancellation of a registered document has to be sought before the competent Civil Court under Section 31 of the Specific Relief Act, 1963, along with declaration of title under Section 34 and appropriate injunction relief. If civil suits regarding the property are already pending before the District Munsif Court, filing a separate writ petition before the High Court for cancellation may not ordinarily be maintainable, particularly where disputed questions of title and facts are involved. The existing suit can generally be amended, if necessary, to include the relief of cancellation/declaration, subject to limitation and other procedural requirements. A writ may be appropriate only in limited circumstances involving a statutory/registration authority’s action or failure to perform a public duty, and not as a substitute for a civil trial. The exact remedy depends upon the dates, nature of both documents, parties to them, and the reliefs already claimed in the pending suits.
