Where to find the records of a previous case for filing a new one

husband filed a hmop case in 2015,wife filed a MC case in 2015 as reply . 2016 they withdraw the case , as both parties agreed to live together. . After 2016 they didnt live together, wife wants to file a hmop. does old hmop case details required , to file new petition. My lawyer not able to get old hmop case details , and says without that i cant apply for new petition. is it true . wat is the best way to handle this.

Every court has to obtain a clearance from the petitioner that no previous cases are pending. If it is then it paves the way for redjudicata stage. It can be identified by many ways. The year of filling is important.

Hello Madam,
It's better to state the previous case details in your new case, as to why did you withdraw at first instance, what was the promise made by your husband and whether he kept his promise or not. All these things will add up nice grounds in your new case. As far as finding up the old case is concerned, it's quite an easy task if we put little effort. since you already knew the year it'll be much easier to find it. If you didn't state about old case and in your new case your husband after appearance states about the same, may be a bad inference will be drawn.
