Do not file defamation, extortion or other cases merely to pressure your wife. Such remedies should be used only if supported by clear evidence. Focus on defending the DV case, seeking visitation/custody rights, and filing a contested divorce if grounds exist. Maintenance is assessed on income, liabilities, and circumstances; ancestral property is generally treated differently from self-acquired assets. Consult me for a case-specific strategy .

If a DV case is already pending, do not initiate any criminal or civil proceedings merely to pressurise your wife or her family. Any legal action such as defamation, criminal intimidation, extortion, or malicious prosecution should be taken only if there is independent evidence supporting those allegations. Filing retaliatory cases without sufficient material may adversely affect your credibility before the Family Court. You should contest the DV proceedings on merits, file your income affidavit truthfully, place all relevant evidence before the court, and, if appropriate, pursue a contested divorce or explore mediation for an amicable settlement. Since there is a minor child involved, the court will also consider the child's welfare while deciding maintenance and other reliefs. Consult your advocate before initiating any separate proceedings.

You have not mentioned which allegations against you in DV case... No reason mentions for separate reside... If she is not willing to reside with you, reside separately without any any reason and only wanted money than you may file petition under section 9 for restitution of conjugal right than thereafter file divorce petition... Deformation or extortion remedy is nothing but wastage of time and money

You can act only if supported by evidence. Don't file defamation/extortion cases merely to pressurize. Defend the DV case, seek divorce if grounds exist, and pursue any genuine independent claims through due process.
