Q: Shared an notice with Section 144 BNSS for Maintenance by Wife

HI Team, Marriage had happen in month of Nov 23 at Indore. After which she has left home thrice and every time husband has called her back. Now she has left husband home in Oct 25, and it has been almost an year now, wife has shared an notice to husband with Section 144 BNSS - Maintenance. I would need ur suggestion, Husband is not ready to give divorce and how he can overcome the maintenance?

Husband threaten me so I came to my mom dad home then he send me normal false letter stating that I am living there by my choice then I send legal notice to husband under section 9 but he doesn't rply..n don't take me home

you already send legal notice... discuss your lawyer and file maintenance petition, domestic violence application or you can also file petition under section 9 of Hindu Marriage Act for restitution of conjugal right along with sec 24 for interim maintenance...



Q: Advice for Maintenance case in hindi marriage act

My maintenance case is going in high court under section 24. Admission process has done. Can I request ITR in court for current salary or court will order on three years back salary slip.

as par you mention your case is pending before High' Court under section 24 whether under civil procedure code or Hindu Marriage Act, under cpc transfer case, under HMA for maintenance both are different things, so far so ITR or salary now is binding on both parties to submit their assets and liabilities before court in any maintenance proceeding , so don't worry



Q: Whether to give monthly or ots ??

My wife DV in dec 2025 n I filed just now contested divorce..I m doing job n my wife no job n 3yr child 6 mnth marriage so I have some fear that if she takes ots n complaint to my office..(may be possible ) as I have some rare illness n some secret my ofc can enquire or may susp# me so if monthly maintenance I m thinking! How many yrs I have to pay monthly or still OTS is better ? I have 2 options monthly. Vs OTS.. as I have very best job I want to save it at any cost.

without details of your marriage life facts, financial, services details, wife financial condition, her parents financial it is not possible to give proper advice... you both filed cases against eachother so it is better to settle matter out of court though reletives or common friends... even though court meditation you can settle the case and amount, discuss your lawyer with your object...
