Married on 21 Feb 2018 wife left for padphera on 25.2.2018 which was against our culture but we don't mind bring her on 28.2.18 and left for honeymoon on 03.04.18 but returned back on 5.4.18 due to non travelling mood of her and she said to leave her at her home but on 5.4.18 she again left for her home and bought her any how on 11.3.18 the next 13 days were hell she use to say mujhe kissi se matlab ni h Bas apne pati se matlab hai in front of my parents and began to quarrel over small issues on 25.4.18 she told that wo mazboori mein reh rhi h and mujh jaise manushya ke saath Kaise reh sakti h n mujhe is Ghar mein ni rehna h n call her uncle he came and sort out d matter and after he left within 2 HR she told to choose between her or my parents in anger I pack her bags called his uncle n dad and explained them her saying her dad said ki use bheja do 2 din mein dimaag Thik ho jayega to wapas Chali jayegi for last 2 months mein Bahut gir giraya but wife se baat ni hui.wants divorce
U can file divorce Case after 1 year of marrige on ground of physical and mental torture by your wife.not giving respect to your parent,wife's non curable mental disorder r also good ground for divorce.Only mutual divorce can be considered by the Court before 1 year
You file case for divorce in family court after one year of your marriage or you may file case for restitution of conjugal right . Their is other provisions for judicial separation but you have to fulfil the requrement of law
Brother sad to hear this. It's very unfortunate thing. I don't know what's wrong with her. Things should be sorted out between both of you. Anyways let's come to the point of law. Well to get divorce, you have to file a petition in family court for decree of divorce but sorry to say you can do it after the completion of one year from the date of marriage, hence, you have to wait for the period. Secondly, if you both mutually want to get divorce, it can be done after the completion of 6 months from the date of marriage (in rare cases). Therefore, in either or case, you have to be patient enough to wait for the right time to file petition in family court for decree of divorce. I hope I made the point of law clear in your case.
