What is the procedure for divorce in India

By way of introduction, I am Ashwini. I am currently living in Singapore and need your advice on getting a divorce in India. My husband and I are living separately for a year now and would like to file for a divorce. I have lived in Mumbai for a couple of years and have a bank account there. On reaching out to a divorce lawyer in Bangalore i was informed that i need to have a bank account in Bangalore to file for a divorce there. Seeking your advice on this. Please let me know what are the options i have in filing for a divorce in India while residing in Singapore. I am not sure if this will be a mutual consent divorce. My husband has agreed to co-operate but I am not very confident about it. We have been married for 5 years now and have no children. Look forward to your advice Thanks in advance

If you are a Hindu you can file a petition for divorce from your permanent place of residence if its Bangalore you can file it in Bangalore if it's Mumbai you can file it in Mumbai.

You need grounds to file for divorce. What is the reason for your separation is very important. For example if there is cruelty what are the cruel acts which caused separation are to I be stated in the petition.

The jurisdiction to file for divorce does not accrue on the basis of having a Bank account in a certain city. In India It is either your present place of residence ( if in India ) or the place in India where you both last resided together. Now if your husband also resides in Singapore you can file for divorce there.However, you can file the same in Mumbai.

If the marriage took place in Bangalore, After your marriage, you and your husband stayed in Bangalore together as husband and wife, at least if you stayed in Bangalore for a brief period after your marriage, you can file for divorce. You can also get divorce by giving a GPA to your parents if they are in Bangalore.

There are various grounds for divorce including mutuals , but it can be only be filed when both party are ready , hence , it would be advisable if you can call us or have online consultation to help you legally , you don't need to have any bank a/C at Bangalore to file case but certain documents, do call or contact : Adv Pankaj Kumar & associate ...
