what is process when charge sheet is ready to be submitted in court?

10-Nov-2023 (In Divorce Law)
Me and my wife are going through a legal dispute. She has put some allegation like 498a in the complaint. 2 months back I had taken bail from police staton. Now the IO said you need to apply for bail from court also. The IO said she will inform me , regrding the date on which they will submit the charge shet in court. Now my question is do I need to apply for bail from court on the same day the charge sheet is submitted or will the court decide a date and send me a summon for the first hearing?

It's advisable for you to apply for the anticipatory bail before the first date of hearing in your case. It will prove to be protective in case the police officials arrest you. You will be released on a personal bond.

when you appears in court it's good if you come with one surety/jmanti court will gives you regular bail on same date...and on first date summon always come or IO tells you date.. if you share your case detail FIR NO OR POLICE STATION NAME with us will tell you exact whats going in case

Yes you Would require to seek a bail in the 498A case once the chargesheet is filed. Though the court will issue Summons to all the accused persons to appear before the court and seek regular bail with one Surety. However you may seek a bail before the date of appearance also. You need to engage a lawyer and seek legal assistance for doing so.

Dear client No Police officer has the power to grant bail in a 498A matter, only and only a competent court has the power to do so. Once the chargesheet is filed, the trial will begin, till then you can only apply for an anticipatory bail since the matter is yet to reach court. Feel free to get in touch to discuss further. Regards
