What are the Proof of a promise

My wife is ready to write if in future is she cheat or adultery then she will give unconditional mutual consent and will not demand any alimony at the time of divorce.what is the best way to record her words, is pen and paper proof is fine or stamp paper or any other procedure .please suggest.

These promise are wont stand .

There is a separate observation with regard to these kind of promise in the Indian Contract Act. It means, Apart from that, as per Hindu law, marriage is not a contract, Please go through the observation/noting under "contingent contract"

As per hindu law marriage is not a contract it is an morel obligation

But for formality purpose you can write it down in any papers . That statement wont legally stand but if something happen it may support.

moreover it is for the mutual consent case. Here both of you agree to separate. There may be lot of reason to separate but in the case of mutual consent you cant express each and all alleging each other .

You can record on stamp paper as memorandum of understanding between both in writing since it would become one document for you in future and helpful since she may file case against u in future and will not consent so it would be helpful to u.

Please file a matrimlnial case for restitutional conjugal rights or the like. Get it compromised in court putting a cindition that you will be entitled for divorce, in future, if such single committed, you are entitled for divorce. More options in person.

I suggest you to record the terms of settlement/acceptance/promise in writing on a sufficient stamp paper with two witnesses who are friends/relative each from either side. This will help you to produce the same before the court in case your wife breaches the terms/conditions.
