what are the grounds and rules of annulment of marriage

I am in Canada on study visa from July 2021 and i came back to india in august, after 1 month nd I married to my boy friend in 2021, Aug via court marriage in ghaziabad but we live in delhi and i knew about his first marriage nd he told me that his divorce been granted but now i got to know that at the time of marriage his divorce was not granted, his 6 month period was going on that time..So, now on d basis of lying nd he was already married at the time of our marriage..I want to know the grounds of annulment of marriage because its been 10 months of our marriage, can i still go for annulment..I want to add more that i didnt live with my husband under 1 roofbecause i left for canada after some days of marriage..I want to go for annulment bacause he cheated..can i go for annulment

Yes you can successfully go for the annulment as it the first ground that is “either spouse was already married to someone else at the time of the marriage in question”. yes yes you can go for annulment of marriage .... u marriage will be declared so by the court of appropriate jurisdiction.....u have to attach the proof of your marriage and his early marriage.... you can also prosecute him for rape if you wish to

Yes the marriage which you performed itself is void according to bigamy section 494 ipc whoever having a wife living n he marries in any case in which such marriage is void. Therefore this is also a case of cheating, bigamy etc

In M.M. Malhotra v. Union of India, the court held that husband married a woman during subsistence of his first marriage. Such marriage being null and void, his subsequent marriage to another women would not be case of plural marriage.
