We Are Not Able Locate My Sisters Husband

Dear sir are madam my sister and his husband separated for more then five years he left her without any reason they have five year old son too now she need ex parte divorce list of documents we need to submit in court proving that they are seperted for more then five years how to apply for child custody steps involved in ex parte

As you informed, your sister husband is saparated since from last five years without any reasnable cause. Hence on the ground of desertion you can apply for divorce.
Passing of exparte order is left to the court only when the husband remained absent to the porceeding after serving of notice. Notice is must and should.
As you infomred they having five year child. Right jow in whos custody the child is there you have not informed. As per law the child below the age of seven years should be with mother cuatody.
Incase if the child is with the mother only no need to file saparate petition for custody of child. In case if the child is with husband you need to file a saparate case and to seek custody.
