03-Nov-2023 (In Divorce Law)
Sir, Me and my partner was living in live in relationship from last 18 months. My partner's husband file divorce case before 15 months and partner filed maintance case this feburary. Her husband has documents of our live in relationship. He showed all documents in front of judges. Judges rejected maintance this october and order to live with her husband. Now i and my partner want to live together again. Can it is possible ? Can judges force a girl to live with her husband ? Girl fundamental right is that she can live with anybody. So what should i have to do ? Today her husband take divorce case back. He never want divorce. He was hunting my partner to fall down in his planing. My partner went to her lawyer and ask that can i go back to my live in partner. Her lawyer replied if she go back then I'll be in serious danger but i know in live in relationship i and my partner can't get blame at all. Is her lawyer making lies ? Can my partner come back to me ? Please suggest me true advise.

Hello sir, as long as she is legally wedded wife of that man, court can order restitution of conjugal rights if she is staying apart from him without any reason. Pl call for further clarification on the issue Thanks Adv Dr Preeti Manderna

Hello you query needs more details of the past litigation between herself and her husband. However if her husband has withdrawn the divorce petition your partner can file divorce petition in the court for grant of decree of divorce. Live-in relationships are accepted if both parties are major/adults in various judgements of the court. please share more details of your cases to advise appropriately.

if she want separation from his husband then she need not to go back to her husband...his husband moved application of rcr through his lawyer and court ordered only for rcr only...but it is not compulsion..she have to take divorce from her husband then only she can live with you
