What is the reason of Moving out of rented accommodation ? Are there any existing disputes between the two of you ? Please contact for a clear discussion on the same. However this action cannot lead him to win a case

You can file a Domestic Violence case against him and get protection order , residence order in your matrimonial house and maintenance order in your favour too without penalising your husband. This would add strength to your case in case he tries to obtain divorce from you in future

As per the Indian laws, it is the duty of the husband to maintain the wife with dignity and respect. It is the duty of the husband to take care of the expenses of his wife and children , including living expenses as well as medical and educational expenses. It will not make any difference if he lives with you and your children at a rented house as long as you all are living happily as a family.
