The petition of divorce can be filed after the completion of period of one year of marriage. There are two options for obtaining the divorce. First is on the mutual consent of both husband and wife. For the mutual consent divorce, the wife and husband file joint petition along with the affidavits of husband and wife separately. The aadhar card, marriage certificate/ Photographs of marriage/ invitation card will be enclosed along with passport size photographs of each husband and wife with the petition. The court will register the divorce petition and take statement of husband and wife. The family court will fixed next date of six months. On the next date once again divorce petition jointly filed by husband and wife and give their statements before family court. The family court on the basis of statement and documents passed the judgment accordingly.
Next option is divorce on contest basis. This divorce petition can be file by husband or wife on the basis of grounds mentioned in Section 13 of Hindu Marriage Act. File it along with your spouse, in case your spouse is also ready for divorce. This would be a mutual consent divorce and would take approx 7 months to conclude.
