Understanding the divorce and memorandum of understanding of separatio

My girlfriend got married 2 years ago and after 2 days of marriage, both of them are not living together and both have signed separation mou and both of them are not in any contact since 2 days of marriage.Now I want to marry her, how to do it? We both are hindu

In your case firstly she must get a divorce done. And if they had already discussed and signed the settlement agreement then they can easily file it before the court to claim mutual divorce. It would take two hearings to conclude the mutual divorce and then she will be free to marry anyone else. For more legal assistance I am just a call away.

She needs to be legally divorced and have to seek a decree of dissolution of marriage. She need to consult and file a petition for divorce, upon getting a decree of divorce she can marry you. Else it Will be an offence of Bigamy under IPC

Intially convince your girlfriend to file a mutual divorce taking MOU as a ground. And after finalisation of divorce decree from the court you can marry from your girlfriend under the Hindu marriage act

Your girlfriend has to get divorce from her husband may be mutual or contested whatever may be the circumstances. Only then it is safe to marry her . Signing MOU is not a conclusive proof of separation.

your girlfriend can marry again only after divorcing her first husband. mou does not have any legal sanctity in law as only a court can grant divorce. should you have any questions please feel free to contact me
