How to file a divorce and get it done soon , what are the legal formalities? how about the child custody in case of minor kid(less than 3 years)

hello as per your query I would suggest you to find that was case as for your personal law . Mutual divorce can also be filled if both the spouse are agree for it . If you want to know about divorce through your Krishna, then if both husband and wife are taking divorce with mutual consent, then for that you will have to prepare a joint plaint and appear in the court and it will take 6 months. Goes and if as you told that your sitting is 3 years old thenHis custody will be given to the mother because the natural gurdian is still your wife, so till the child turns 7 years old, the natural garden is the mother

there are two modes for filing of divorce cases. first on the basis of mutual consent, If both the parties are mutually agreed for divorce and second If only one of the spouses want divorce on a ground provided under the law. Legally mother is entitled for the custody of children to the 5 yrs of age. paramount consideration is welfare of the child deciding the custody of the child.
