Travel Abroad with Child for job

26-Feb-2023 (In Divorce Law)
Hi, my husband has been given access to meet child every alternate Saturday in family court premises which he takes regularly . Also during COVID-19 lockdown the access was through phone calls. He is not allowed outside access to child due to safety reasons. Husband also has DV n 498 against him with strong evidence n he has got arrested too. Matter is on since past 8 years. I am receiving only 15k monthly maintenance for both me and the child as per court orders, which he is paying regularly. He also pays the child’s school fees as per court orders. I have now got an offer for a well-paying job abroad which will lead to a better future for the child. Especially since 15k monthly maintenance is not enough for me and child to survive. The new job will allow a better future for me and child. How can I go for the job abroad? What are my options please?

Hello there! you will have to inform the said fact to the court and request access to child over video call. you may not get maintenance amount or may get lesser than now. but it will be easy for you if you intimate the court.

If you are willing to do job in future in abroad you have to inform the court regarding that and in that situation you will not be entitled to get maintenance from your hubby. Only your child will be entitled. But court has to execute the arrangements how to allow child to meet father.

You will not get Maintenance if you choose to go abroad for doing Job. You can't get both benefits. Thus, go abroad after getting Job-Offer & don't disclose to anybody, that, you have got the Job abroad until you get settled over there with your child for a couple of months. You have to make aj excuse with your Husband. Otherwise, if your Husband will get to know, he will move to the Court to stop your Maintenance.
