Total cost and duration of contested divorce in Bangalore

11-Mar-2026 (In Divorce Law)
I am a Hindu male working in Bangalore. My spouse lives in the USA with our minor child and we have been living separately since November 2023. Mutual divorce may not be possible as she is not willing to travel to India. What is the approximate total cost to complete a contested divorce in Bangalore, including lawyer fees and court expenses, and the expected duration, when the other spouse resides abroad?

Good question to ask in such situation : if your wife is responsive to your communication the matter maybe over in one and half year- otherwise it will strech to over 2 years. it is a policy of Indian courts not to grant divorce before 2 years when other spouse is not responding to notices by Court. Cost depends upon brand value of the Lawyer- office etc.

Dear Sir, Since you are a Hindu male residing in Bangalore, the petition for a contested divorce would be filed under the Hindu Marriage Act, 1955, in the Family Court of Bangalore. Given that your spouse is in the USA, the court will issue a summons that can be served via registered post or, with court permission, through electronic means (email/WhatsApp) or the Indian Embassy. 2. Expected Duration A contested divorce involving an overseas spouse generally takes 3 to 5 years, depending on the complexity of the case and the level of cooperation. Key factors influencing the timeline include: The time taken for service of summons to the USA. The nature of the contest (grounds like cruelty, desertion, etc.). Matters of child custody and maintenance. 3. Estimated Costs The total cost varies significantly based on the senior status of the legal counsel and the volume of litigation: Court Fees: Minimal, as per the Karnataka Court-Fees and Suits Valuation Act. Professional Fees: Lawyer fees for contested matters in Bangalore can range from ₹1,00,000 to ₹5,00,000+, often billed per hearing or in stages (filing, evidence, final arguments).

Hello sir, Since you are a Hindu and the marriage is governed by the Hindu Marriage Act, 1955, you can file a contested divorce petition in the Family Court at Bangalore if the marriage was solemnized here or you last lived together here, or if you currently reside here. A contested divorce generally takes 6 months to 3 years depending on evidence, appearance of the other spouse, and court workload.

Contested divorce with international elements can be complex. Here's a general outline: *Grounds for divorce*: Identify valid grounds (e.g., cruelty, desertion). *File petition*: Your lawyer'll draft and file the petition in the Family Court, Bangalore. *Serve notice*: Serve notice to your wife in the USA (via diplomatic channels or Hague Service Convention). *Response*: Wife'll respond, likely contesting the petition. *Evidence and hearings*: Gather evidence, attend court hearings.
