Questions Answered by Advocate Praveenkumar S
Q: Medical insurance issue and no response from my advocate
I have two issues right now. First. I contacted and paid a lawyer regarding medical isurance of my senior citizen mother which the company conveniently refused after many years of paing premium. Second, the advocate has not been communicating and it seems he has now stopped working on it. I have already paid the full amount in parts which he quoted for fighting the case . I really am frustrated and don't know what to do.
Advocate Praveenkumar S answered
File with Insurance Ombudsman Bangalore and Consumer Forum immediately. Insurers can't reject claims after 3 years without proving fraud under Sec 45 Insurance Act. Send legal notice demanding claim + 12% interest + compensation. Attach policy, premium receipts, rejection letter. Share rejection reason for specific strategy Seconly, Send a written demand via WhatsApp/email asking for case status and refund within 7 days. If ignored, file complaint with State Bar Council for professional misconduct under Sec 35 Advocates Act. Simultaneously, file Consumer Forum case for deficiency in service to recover fees + compensation. Engage new lawyer immediately.
Q: Consultant with Unpaid salary for the months of March and April of 202
HI, I was employed as a consultant with Iskcon Bangalore - with unpaid salaried a complaint has been given in the Labour commissioner's office they have sent a notice to me and employer to appear at their office tomorrowHow this can be solved with maximum compensation - they have literally made me starve
Advocate Praveenkumar S answered
Attend tomorrow’s Labour Commissioner hearing with all proof: appointment letter, work emails, attendance, bank statements showing non-payment, and a dues calculation sheet. Argue that despite the “consultant” title, you worked as an employee — fixed hours, supervision, at their premises — so Payment of Wages Act, 1936 and Karnataka Shops & Establishments Act apply. Claim full unpaid salary plus penalty up to 10 times delayed wages under Sec 15(3) if employer had no reasonable cause, and request compensation for financial hardship. Present “illegally made to starve” factually with evidence like zero balance or debts, not emotionally. The Officer will attempt conciliation first; demand 100% dues plus minimum 50-100% penalty and don’t accept verbal promises or sign full and final below 80% without written terms. If no settlement, insist on an order for recovery. Don’t admit full autonomy as a consultant. Arrive early, dress formally, stick to facts. Maximum compensation depends on penalty awarded, so emphasize mala fide delay and livelihood loss while letting the Officer decide quantum.
Q: Termination without notice & pending salary issue
I was working in a company and recently got terminated without proper notice or discussion. They have not clearly explained the reason and there are concerns regarding notice period and pending dues. I have already asked for clarification but did not receive a proper response. What legal action can I take to recover my dues and handle this termination?
Advocate Praveenkumar S answered
Illegal if no notice/pay given. Check appointment letter for notice terms. Collect proof: salary slips, termination mail. Send lawyer’s legal notice demanding dues. File complaint with Labour Commissioner, Bangalore under Industrial Disputes Act. If unresolved, approach Labour Court within 3 years. Don’t sign forced resignation.
Q: Hi. How to get divorcewife asked maintenance only and may b
Hi. How to get divorcewife asked maintenance only and may be she didn't agree to give divorce and what husband can do to get divorce from wife .
Advocate Praveenkumar S answered
Under Indian law, a wife can claim maintenance via *Section 125 CrPC* without seeking divorce. Courts often award 20-30% of husband’s net income. If the husband wants divorce, he must file a *contested divorce* under Hindu Marriage Act grounds like *cruelty* or *desertion* for 2+ years. Mutual consent isn’t possible if wife refuses.Divorce filing doesn’t stop maintenance — interim support under Sec 24 HMA/Sec 125 CrPC continues. Husband can reduce it by proving liabilities, dependents, or wife’s income.Strategy: contest Sec 125 with financial proof, consider *Sec 9 RCR* to show desertion later, then file divorce with evidence. Non-payment of court-ordered maintenance risks arrest. Consult a Bangalore family lawyer.
Q: Received a legal notice from the company i had contacted for loans
Hi,I put up a review on Trust pilot based on my experience with this company . Now they sent me a legal notice and defamation notice along with 2 lakh fine as i refused to take down the review. Can you advise if they can do this since I only gave review based on my experience from their services.
Advocate Praveenkumar S answered
*1. Is a bad review defamation?* In India, *truth + public interest = complete defense* under Section 356 of BNS 2023. A genuine review based on your experience is _not_ defamation if:- What you wrote was true or your honest opinion- You weren’t making up facts to harm them- It’s about service quality — that’s public interest*2. What to do right now*Step Why it matters**Don’t delete the review yet** Deleting can look like admitting it was false. Keep screenshots**Save proof** Bills, emails, chats, photos of poor service — anything backing your review**Read the notice carefully** Is it a legal notice from a lawyer or just a company email? Check deadline to reply**Don’t panic & don’t ignore** Ignoring a court summons is bad. Ignoring a lawyer notice just gives them next move*3. How to reply to the notice*You/your lawyer should reply stating:1. The review reflects your genuine consumer experience 2. Facts stated are true and you have evidence3. It’s fair comment protected under Article 19(1)(a) — freedom of speech4. Consumer reviews are protected under Consumer Protection Act 2019*5. When it gets serious* If they file a civil/criminal defamation case:- *Civil*: They claim money damages. You defend with truth- *Criminal Sec 356 BNS*: Police/court involved, but for reviews it’s rare and courts often dismiss if it’s genuine consumer feedback*Next steps I’d suggest:*1. Gather all proof of your experience with the company2. Talk to a lawyer in Bangalore for a reply notice — many do first consult free/cheap3. You can also file a complaint with Consumer Forum if their service was actually deficient
