To send legal notice first for divorce

Im diagnosed with complex neurologic 2 year ago after that my wife made my life like a hell due to this my health condition is deteriorating fast, she is not taking proper care of 3 year old daughter too. We are 9 years married and living under same roof. Can i get divorced for betterment of my health and child future ?nIs it possible to send legal notice 1st if yes then how ?

आप आपसी सहमति से 13b हिंदू मैरिज एक्ट का तलाक की याचिका दायर कर दे संबंधित कोर्ट में अगर आपकी पत्नी सहमत नहीं तो 13a का मुकदमा दायर कर दो ज्यादा जानकारी के लिए आप मुझे कॉल कर सकते है या आप मेरे कार्यालय पर आकर अपनी समस्या का समाधान करा सकते हैं

for the purpose of divorce The legal notice not mandatory if you want to give threat only then you can send a legal notice of divorce otherwise it is not mandatory. for the divorce you should file an divorce petition in under section 13 Hindu marriage act.

if you want divorce from your wife then you can file a suit for divorce by mutual consent if your wife is also ready. If your wife is not ready then you can also file divorce case on various grounds. There is no legal requirement to serve a notice upon your wife for filing a case for divorce. Living under the same roof is also not a bar for filing divorce case.
