Merely being unemployed does not automatically exempt a person from paying maintenance. The Court examines overall circumstances, including educational qualifications, earning capacity, assets, previous employment, income sources, and financial status. If your spouse has already received a full and final one-time settlement under a valid settlement agreement or mutual consent divorce decree, and the settlement specifically records waiver of future maintenance claims, the same can be a strong defence against any subsequent maintenance claim. However, the outcome depends on the exact terms of the settlement, the divorce decree, and surrounding facts. Preserve all settlement documents, payment proofs, bank records, receipts, and court orders. A detailed examination of the settlement terms is essential before assessing the sustainability of any future maintenance claim.
