the requirement of having both the parties of divorce to be present

when the case is not in mutual consent then both husband and wife is it compulsory for both of them to ne present before the court when the dates are announced if on of them is not in the country for their future studies then how will the procedure goes ahead

Your lawyer can handle this, but your presence will be required at some stages. For instance chief examination and cross examination.

And at such time if the court expressly requires you to be there.

At the moment there is an opportunity to do it through virtual court.

Dear Sir,
Atleast once the presence of both the parties is necessary otherwise no mutual divorce will happen. For non effective hearings one of the party may execute Special Power of Attorney and when required both the parties shall appear before the Court and sign the Order Sheet.

it is not required that on every date the party should be present it is sufficient if the party is present at the time of evidence, further through power of attorney or video conferencing the case can be also proceeded.
