Subjected to domestic violence in the US

My sister got married two years back and settled in US, recently when they were here for vacation, she opened up on day after she had a verbal despute with her husband that her husband used to beat her left and right whenever she refused to listen to him or didn't obey to whatever he said. He is dominant and never listen to her opinions or decisions. Her verbal despute would end up into violence by him. When my family intervened he cancelled her ticket and flied back to US. My sister has all the documents there and has been leaving with us here. When discussed with her family they asked her to take a divorce if you cannot adjust. We are ready for divorce if he cannot change as he has said it in a conversation. How can we get legal help on this case

You can file for a domestic violence case in India as well.. and issue summons to him in US and his family. You can also file Restitution of conjugal rights case or divorce case in family court in India..

Sorry to know about your situation. Is he an NRI? If not and if the marriage was conducted in India and the couples lived for sometime in India then she fairly has a chance to get legal remedies to address her issue.

you can go for a mutual consent divorce petition and if you want alimony then you have to file divorce case one sided and can claim monthly maintenance and also you can claim permannent alimony from him and there are others ways where you can teach him and his family members a lesson for being stubborn
