Separating from my wife through lok adalat

My divorce case is being pending for the past 5 years, I am in touch with my wife for the past 2 years, we have a son, I am ready to support my son financially, we are thinking of living separately without getting a divorce, is it possible to get an amicable settlement through lok adalat that we want to live separately? my son is living with my wife and she is a working woman.

yes in divorce case only the court has a power to grant judicial separation instead of a divorce, it can be done through Lok adalat also or by the court also, by passing an order of judicial separation you can live separately without getting divorced, so go for it.

In case if you want to saparate without divorce then you can go for judicial saparation as contemplated under section 10 of the Hindu marraige Act. Here after decree you can live saparatly withiout disturbance of other spouce.

As you told you case is pending. You can refer the case for mediation there you can try for the same. I hope a saparate petition need to be filed for the same.
