Separately living from wife for years now wants to file for divorce

I'm a 42 year old Hindu Air Force officer, married in Kanpur in 2006. Seperated on basis of a letter written by my wife in 2013 when I was posted to Lukhnow. Presently I'm posted to Bagdogra, WB. My wife has moved to Gurgaon from Lukhnow and for the last 2 years I don't even know where she is staying. I have 1 son, 10 years old and haven't seen him since Mar 16. I'm paying her approx ₹28000/- pm through air force. I want to file for divorce and need to where to file and on what grounds.

For the query you posted, I would suggest the following:

Divorce proceedings can be filed before the concerned adjudicating authority on various grounds.

Further the same will be proceeded with either where the couple last resided or where the lady is staying.

Sir good day and salute to your proffession . Sir where you are posted you can file at the area jurisdiction you kindly go to the nearest family court or which ever court you have in your area and ask the jurisdiction there . Second file for mutual Divorce as right now you did not mention that why did your wife left you . But yes mutual Divorce is the best . You have to take address of wife from your office to send the summon to her at that place only . In mutual Divorce application you mention that with Divorce you will give one time alimony to wife for life . But kid can ask for anything any time till you are there. And you have to do one thing that for your pension as your wife or the kid who ever your want it to get it after you are not there . Yes this is mandatory.

You need to file divorce petition on the grounds of mental cruelty at the nearest family court where you are staying and state them all the important facts and circumstances about your life.. . . . . . . .

you can file divorce on grounds of dessertion, cruelty and can also get the custody of your child. You get the decree in your favor and get the divorce done also if she agreed a mutual divorce can also be filed

For proper advice you have to share the complete history behind your matrimonial development. Although you have a good ground to file a case as desertion is there in the part of your wife. You may certainly file a case at Kanpur, where marriage took place but you may also file a case where you both resided together as husband and wife.
