Hi can u guide me what's the procedure for legal separation in India and about the custody of my child that can be worked out mutually as she's a girl child just 8yrs old she may need me.

if you are looking to file divorce then you can file mutual consent divorce or contesting divorce before family court. if you are looking for judicial sepration and not for divorce then that also has to to be filed before family court. if your husband is trying to get the child custody then you can filed one application under G@W act and seek the child cutoff before family court. if its mutual consent divorce, u need to file petition under section 13B of the hindu marriage act jointly representing husband and wife, thereafter the matter will be referred to mediation after 6 months and if both husband and wife agree for the terms of settlement then immediately divorce and if there is no mutual consent then u have to file petition under section 13 and contest for divorce

you have to file a petition seeking custody of the child and also file a case for divorce! if u elaborate the facts then can guide better! Divorce is not the only solution! Bear in mind the future of the child
