Q: Seeking for separation in marriage

Hi can u guide me what's the procedure for legal separation in India and about the custody of my child that can be worked out mutually as she's a girl child just 8yrs old she may need me.

if its mutual consent divorce, u need to file petition under section 13B of the hindu marriage act jointly representing husband and wife, thereafter the matter will be referred to mediation after 6 months and if both husband and wife agree for the terms of settlement then immediately divorce and if there is no mutual consent then u have to file petition under section 13 and contest for divorce

Q: property registration (Home - On three person)

Me and my sisters ( Two sister) are buying one home for my parents and we have to make so we can not register it to my parents . Me my brother in laws are equally investing in it. whether we can register jointly ( mean to say all three together)

since u n ur sister is investing and also ur brother in law is also involved in buying the property, u can register it jointly in three of ur names, sharing ratio needs to be specifiedand since property is flat conditions needs to be specific qith regard to preemption right incase if one among u wants to sell their share

I need divorce from my husband... he is an indian n I'm tibetan.... I need to knw about the procedure for divorce n my husband is not ready to hive me divorce .... i cant tolerate his torture.... plz help me with this

u need to file a petition for divorce before the family court, if the marriage is under special marriage act u need to file petition under that provision, there are certain instances and circumstances in which divorce can be obtained like cruelty, harassment, dowry demand, impotency etcif u can prove one of them, the court will grant u divorce

yes u can file a divorce petition under section 13 of the hindu marriage actthere are certain circumstances and occassion on which divorce can be obtained like infidelity, harassment, dowry demand, impotency, vegetative diseaseif one can prove the reasons for divorce then court will grant u divorce

no a husband cannot file a case under section 498A , that section is in aid only for the wife and not otherwiseu can file a petition for divorce on adultery as a ground u can file a cheating case on ur wife
