Seeking for Divorce due to mental torture

27-Oct-2023 (In Divorce Law)
My marriage life lasted for 8 months together(stayed without my parents) and we are living separately for 6 months now. nI got all the possible mental torture from my wife - " I should not connect with my family members, should spend my salary to her and her family members only. If any savings planned it should be in her name. If not I should give Divorce or else she will commit suicide saying me & my family as reason".I'm not able to bare this stuff, so left her and staying with my parents now. I'm looking for divorce but she is not OK for it. I don't have any physical evidence to prove her mental torture other than my bank statement that says all my expenses are towards jwellery or her family expense. Can I file divorce with this?

First and foremost you need to have been Married for atleast 1 year and only then you can pursue a divorce. Since she is not agreeing for a divorce and you still want to proceed, it would be that of a contested one and not a mutual consent petition. Yes, the details shared amount to cruelty (mental ) which is a ground for divorce. Your bank account statement can be used as evidence to some extent. Going forward, you can start collecting evidence by way of messages/ call records if you’ll still have any such conversations. Do let me know how I can assist you further.

Dear Sir, Getting divorce for husband's is very hard unless there is a ground of adultery etc. Anyway to safeguard yourself from future consequences you may file Divorce case. There are chances of multiple cases being filed by your wife for maintenance, domestic violence etc. Please aware that divorce process may take upto three years.

As per Law you can file for divorce only after 1 year of marriage. In the present circumstances she can file for maintenance are any case against you so you have to think of some precaution. however you can seek the order of court to permit you to leave separately from her by making allegations about the torture.
