Section 9 and divorce petition together ???

Hi i want to take divorce from my wife as her attitude has been very bad towards marriage. In 4.5 year marriage, she hardly has stayed for 6 months with me. for last 1.5 year she is at her home and always demands me to get separated from my parents.
I talked to a lawyer recently. He told me that he will file section 9 and after a week he will file a divorce petition. He will file these two things together. But i m confused is it possible to file a section 9 and a divorce petetion together.
not not possible to file it I was at first place Tu Mile case under section 9 Indian wait for sometime to file a divorce case Court did not want to break any family at any cost it is extreme extra if you should take divorce is not an easy process so please be patience if you need for the advice for me please contact me thank you

I have peruse your all queries. in my opinion you can not file petition for divorce and restitution of conjugal right under section 9 Hindu Marriage Act simultaneously. you should file section 9 petition first and after the decision. you should file execution petition against your wife. if your wife still not ready to live with you then you should file a petition for divorce on grounds of separation and in this case this judgment and decree will be very helpful for obtaining decree of divorce. if you want any further information or any other advice then contact me without any hesitation through administrator of this website for the contact details of me
